Terms of Service

Introduction
These Terms of Service constitute a legally binding agreement between you and Kickers United Soccer Academy Inc. governing access to and use of the Academy website, online registration systems, digital communications, payment platforms, and participation in Academy programs, and by accessing the website, registering a participant, or completing payment you acknowledge that you have read, understood, and agree to be bound by these Terms and all related Academy policies incorporated by reference.
Corporate Status
The Academy is a corporation incorporated in the Province of Ontario, Canada and operates youth athletic programming in accordance with applicable federal and provincial laws.
Eligibility and Authority
By registering a participant, you represent and warrant that you are the lawful parent or court appointed legal guardian of the minor participant, are of the age of majority in Ontario, and possess full legal authority to bind the participant to these Terms and all related Academy policies.
Electronic Acceptance and Legal Effect
Submission of an online registration form, checking required acknowledgment boxes, typing your name as signature, and completing payment constitute legally binding electronic acceptance under the Electronic Commerce Act, 2000 Ontario and have the same legal force and effect as a handwritten signature.
Registration Integrity and Recordkeeping
The Academy maintains electronic records of registrations including timestamps, IP addresses, device identifiers, policy version references, acknowledgment confirmations, and payment transaction records for purposes of legal enforceability, fraud prevention, dispute resolution, and regulatory compliance, and such records may be relied upon as evidence of agreement.
Nature of Services
The Academy provides structured youth athletic training, league participation, skill development programming, camps, clinics, and related services, and website content is provided for informational purposes only and does not constitute medical, legal, or professional advice.
Accuracy of Information
You agree that all information provided during registration and communication shall be accurate, complete, and current, and the Academy reserves the right to suspend or terminate participation where inaccurate information materially affects safety, insurance compliance, regulatory requirements, or operational administration.
Program Modifications
The Academy reserves the right to modify schedules, venues, coaching assignments, or program structures where reasonably necessary for safety, operational efficiency, weather conditions, regulatory compliance, or facility availability without constituting breach of contract.
Fees, Payment, and Confirmation
Participation is conditional upon timely payment of fees through secure third-party payment providers, registration is not confirmed until payment is successfully processed, and all payment matters are subject to the Academy’s Refund Policy. Failure to complete payment within the required timeframe may result in cancellation of registration without notice.
Chargebacks and Payment Disputes
You agree to contact the Academy directly to resolve any payment concerns prior to initiating a chargeback or payment dispute with your financial institution, and the Academy reserves the right to provide registration records, acceptance logs, and policy acknowledgments in response to such disputes.
Website Use
The website may be used solely for lawful informational and registration purposes consistent with Academy operations.
Prohibited Conduct
Users shall not attempt unauthorized access to systems, interfere with website functionality, introduce malicious code, submit fraudulent information, harvest personal data, impersonate others, or engage in conduct that disrupts Academy operations.
Intellectual Property
All branding, curriculum, training materials, digital content, graphics, photographs, videos, and proprietary systems are owned by or licensed to the Academy and are protected under Canadian intellectual property law, and unauthorized reproduction, distribution, or commercial exploitation is prohibited.
Disclaimer of Warranties
The website and services are provided on an as is and as available basis without warranties except where such warranties cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by law, the Academy shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from website use or program participation except where liability cannot legally be excluded.
Indemnification
You agree to indemnify and hold harmless the Academy from claims arising from your breach of these Terms, submission of inaccurate information, or misuse of the website or services.
Dispute Resolution
In the event of any dispute arising from participation or website use, the parties agree to first attempt resolution through good faith discussion prior to commencing legal proceedings.
Severability
If any provision is determined invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Relationship Between Terms and Participation Agreement
In the event of any inconsistency between these Terms and the Participation Agreement relating to physical activity participation, injury, assumption of risk, release of liability, or similar matters, the Participation Agreement shall govern.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
